Nothing in these terms removes any right, guarantee, remedy or liability that cannot legally be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.
Part One
Privacy Policy.
1. Who We Are
HiGoTec™ Pty Ltd (HiGoTec™, we, us or our) is an Australian technology company. This policy explains how we handle personal information connected with this public website and our related business activities.
2. Information Collected Through This Website
The public website does not currently include a contact form, user registration, online purchasing or payment facilities.
When the website is visited, our web server may automatically record limited technical information such as an IP address, browser type, requested page, date and time, referral information, and security or error information. This information is used to operate, secure, maintain and diagnose the website.

If you believe we have mishandled your personal information, please write to our Privacy Officer using the postal address below. Your correspondence should explain the issue and provide enough information for us to identify and investigate it.
After receiving your written complaint, we will confirm that it has been received, assess and investigate the matter, and provide our response within 30 business days.
If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner at oaic.gov.au.
10. Connected Services
Mission Control and other HiGoTec™-operated or affiliated products and services may collect account, transaction, content, communication, usage or service information that this public website does not collect.
Their specific privacy notices and terms will explain the information collected and how it is handled as those services become available.
Where reasonably necessary to provide connected or integrated functions, information may be used or shared across those products, services and affiliated business operations in accordance with the applicable privacy notice, terms and law.

If there is an inconsistency, the specific terms for that service apply to its use or purchase, while these terms continue to apply to this public website.
7. Website Availability And Security
The website is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, continuous, timely, secure or error-free access, or that defects will be corrected.
Maintenance, faults, internet conditions, hosting failures, cyber incidents, third-party conduct or circumstances outside our reasonable control may affect the website. We may suspend, withdraw, restrict or change any part of the website at any time.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot legally be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or any other applicable law.
Any terms applying to a paid HiGoTec™ product or service will be provided at the relevant point of registration or purchase. Those terms will not remove any right or remedy that the law says cannot be removed.
9. Responsibility For Loss
You access, use and rely on this website, its content and any linked information at your own risk.
To the maximum extent permitted by law, all representations, warranties, guarantees, conditions, liabilities and remedies relating to the website or its content that are not expressly stated in these terms are excluded.
To the maximum extent permitted by law, HiGoTec™ and its related companies, affiliated businesses, officers, employees, contractors, licensors and service providers are not liable for any direct, indirect, incidental, special, exemplary or consequential loss, damage, cost or expense arising out of or connected with:
access to, use of, reliance on or inability to use the website or its content;
inaccurate, incomplete, outdated, unavailable or misleading information;
interruption, delay, error, defect, loss of data, malicious code or security incident;
unauthorised third-party access, conduct or interference;
a third-party website, product, service or content; or
any decision, action or omission based on website information.
The exclusions in clause 9.3 include, without limitation, loss of profit, revenue, savings, business, opportunity, goodwill, reputation, data or anticipated benefit, whether the loss was foreseeable or not and regardless of the legal basis on which liability is alleged.
Where liability cannot lawfully be excluded but may be limited, our liability is limited to the minimum amount or remedy permitted by law.
Nothing in this section excludes, restricts or modifies a right, remedy or liability to the extent that doing so would be unlawful.

These terms are governed by the laws of Queensland, Australia. The courts of Queensland and courts entitled to hear appeals from them have jurisdiction, subject to any right you have to bring a matter elsewhere under applicable law.
12. Severability And Waiver
If any part of these terms is found to be invalid, unlawful or unenforceable, that part will be read down to the minimum extent necessary or, if it cannot be read down, severed. The remaining terms will continue to operate.
A delay or failure by us to exercise a right under these terms does not waive that right.
